Data Breach Response Plan for Kenya
A data breach response plan is the documented playbook an organization follows in the first hours and days after discovering unauthorized access to personal data. Under Section 43 of the Kenya Data Protection Act, 2019, a data controller must notify the Office of the Data Protection Commissioner (ODPC) without delay, and within 72 hours of becoming aware of a breach. If the breach is likely to affect individuals, they must be informed too. Organizations without a tested plan routinely miss that window. Exposure runs from administrative fines of up to KES 5 million or 1% of annual turnover to criminal penalties of up to KES 3 million and 10 years of imprisonment.
